NOTICE OF MORTGAGE FORECLOSURE SALE Notice of foreclosure by advertisement. Notice is given under section 3212 of the revised judicature act of 1961, 1961 PA 236, MCL 600.3212, that the following mortgage will be foreclosed by a sale of the mortgaged premises, or some part of them, at a public auction sale to the highest bidder for cash or cashier’s check at the place of holding the circuit court in Bay County, starting promptly at 11:00 a.m. on December 6, 2024. The amount due on the mortgage may be greater on the day of the sale. Placing the highest bid at the sale does not automatically entitle the purchaser to free and clear ownership of the property. A potential purchaser is encouraged to contact the register of deeds office or a title insurance company, either of which may charge a fee for this information. Default has been made in the terms and conditions of a Mortgage made by Jennifer Brown and Ndegwa Brown, wife and husband, as Mortgagors, to Frankenmuth Credit Union, as Mortgagee, dated April 8, 2019, recorded April 22, 2019 as Instrument No. 201905836 of Bay County, Michigan records (the “Mortgage”). The amount claimed to be due and owing on the Mortgage is Seventy Five Thousand Four Hundred Forty Six and 75/100 Dollars ($75,446.75) on the date of this Notice. The Mortgage contains a power of sale and no suit or proceeding at law or in equity has been instituted to recover the debt secured by the Mortgage, or any part of the Mortgage. Under the power of sale contained in said Mortgage, and the statute in such case made and provided, take notice that on December 6, 2024 at 11:00 a.m., local time, or any adjourned date thereafter, the Mortgage will be foreclosed by sale of the mortgaged premises, or some part of them, at public auction, to the highest bidder, at the place of holding the Circuit Court within Bay County, Michigan. The Mortgagee will apply the sale proceeds to the debt secured by the Mortgage as stated above, plus interest accruing on the amount due at a rate of 8.75% per annum, costs and expenses of the Mortgagee as provided for in the Mortgage, and any amounts subsequently paid by the Mortgagee to protect its interest in the property. The property to be sold at foreclosure is all of the real estate and improvements located in the City of Essexville, County of Bay and State of Michigan, more particularly described as follows: A piece of land commencing at a point on the East side line of Woodside Avenue, 477.1 feet Northerly from the North side line of Borton Avenue; running thence Northeasterly along the Easterly side line of Woodside Avenue, 57 feet, more or less, to the angle in said Woodside Avenue; thence Northeasterly along the Southerly side line of Woodside Avenue, 38 feet; thence South on a line parallel with the East line of Atlantic Salt Company land 81 feet; thence West to the place of beginning; being a part of Lot 1 of Assessor’s Plat of Atlantic Salt Company’s Addition to the Village of Essexville, as per plat thereof recorded in Liber 4 of Plats, Page 41 of Bay County records. And Commencing at a point on the North side line of Borton Avenue 325.86 feet East from the point of intersection of the Easterly side of Woodside Avenue; thence North 360 feet to the point of beginning; thence West 50 feet; thence North 133 feet to the Southerly side line of Woodside Avenue; thence Easterly on the Southerly side line of Woodside Avenue 55.40 feet; thence South 157 feet to the place of beginning. Also known as Lot 2, Block 4 of Atlantic Salt Company’s Addition to the Village of Essexville, as per plat thereof recorded in Liber 4 of Plats, Page 41 of Bay County records. Tax Parcel No: 09-170-A10-000-002-00 Commonly known as: 208/212 Woodside Avenue, Essexville, MI 48732 The redemption period shall be six (6) months from the date of sale, unless determined to be abandoned in accordance with MCL 600.3241a, in which case the redemption period shall be 30 days from the date of such sale. Pursuant to MCL 600.3278, the Mortgagors will be held responsible to the person who buys the property at the foreclosure sale or to the mortgage holder for damaging the property during the redemption period. Attention Purchasers: This sale may be rescinded by the foreclosing mortgagee for any reason.
