MORTGAGE FORECLOSURE NOTICE Notice of foreclosure by advertisement. Notice is given under Section 3212 of the Revised Judicature Act of 1961, 1961 PA 236, MCL 600.3212, that the following mortgage will be foreclosed by a sale of the mortgaged premises, or some part of them, at a public auction sale to the highest bidder for cash or cashier’s check at the place of holding the circuit court in Bay County, starting promptly at 11:00 A.M., on December 1, 2023. The amount due on the mortgage may be greater on the day of the sale. Placing the highest bid at the sale does not automatically entitle the purchaser to free and clear ownership of the property. A potential purchaser is encouraged to contact the county register of deeds office or a title insurance company, either of which may charge a fee for this information. Angenette S. Hardy and John R. Studniarz, a single man, as joint tenants with full rights of survivorship, (“Mortgagor(s)”), gave a mortgage to Member First Mortgage, LLC., (“Mortgagee”), dated June 29, 2007, and recorded on August 1, 2007, in Liber 2551, on Page 161, Bay County Records, Michigan. On the date of this notice, there is claimed to be due the principal of Fifty-Nine Thousand One Hundred Forty-Eight and 32/100 Dollars ($59,148.32) plus accrued interest at 7.125% per annum. Under the power of sale contained in said mortgage and the statute in such case made and provided, notice is hereby given that said mortgage will be foreclosed by a sale of the mortgaged premises, or some part of them, at the place of holding in the circuit court within Bay County, Michigan @ 11:00 A.M. on Friday, December 1, 2023. Said premises are situated in the City of Bay City, Bay County, Michigan, and are described as: The South 100 feet of Lot 11, Block 2 of “H.J.H. Schutjes Subdivision”, as recorded in Liber 1, Page 54, of Plats, Bay County Records Commonly: 1919 4th Street Bay City, MI 48708—Tax Id#09-160-022-333-015-00 The redemption period shall be six months from the date of such sale unless determined abandoned in accordance with MCLA 600.3241a, in which case the redemption period shall be 30 days from the date of such sale. If the property is sold at a foreclosure sale, under Section 600.3278 of the Michigan Compiled Laws, the Mortgagor will be held responsible to the person who buys the property at the mortgage foreclosure or to the mortgage holder for damaging the property during the redemption period.
