Notice is given under section 3212 of the revised judicature act of 1961, 1961 PA 236, MCL 600.3212, that the following mortgage will be foreclosed by a sale of the mortgaged premises, or some part of them, at a public auction sale to the highest bidder for cash or cashier’s check at the place of holding the circuit court in BAY County, starting promptly at 11:00 AM, on October 20, 2023. The amount due on the mortgage may be greater on the day of the sale. Placing the highest bid at the sale does not automatically entitle the purchaser to free and clear ownership of the property. Sanchez, a married man, whose address is 2844 Tupper Drive, Bay City, Michigan 48706, as original Mortgagors, to Mortgage Electronic Registration Systems, Inc., as nominee for Independence Mortgage Company, a Division of First Independence Bank, being a mortgage dated September 3, 2010, and recorded on September 22, 2010 in Liber 2759 Page 246, Bay County Records, State of Michigan. Said mortgage is now held through mesne assignments by Wilmington Savings Fund Society, FSB, as Trustee of Quercus Mortgage Investment Trust, as assignee as documented by an assignment dated January 23, 2020 and recorded on January 27, 2020 with Document Number 202001144, Bay County Records, Michigan, on which mortgage there is claimed to be due at the date hereof the sum of TWO HUNDRED TWENTY-TWO THOUSAND SEVEN HUNDRED TWENTY-SEVEN AND 17/100 DOLLARS ($222,727.17). Said premises are situated in the Township of Monitor, County of Bay, State of Michigan, and are described as: The Northerly 1/2 of Lot 2 and the entire Lot 1, Thos C. Tupper Subdivision, according to the recorded plat thereof, as recorded in Liber 5 of Plats, Page 40. Also a certain parcel of land lying adjacent thereto and bounded on the Northeasterly side by the Southwesterly Right of Way line of Highway U.S. 23 (now known as M-13) bounded on the Southwesterly side by the Northeasterly side line of Lot 1 of said Thos C. Tupper Subdivision; bounded on the Northwesterly side by the Southeasterly line Tupper Drive, and bounded on the Southeasterly side by the Southeasterly line of said Lot 1, Thos C. Tupper Subdivision if extended to the Westerly Right of Way line of U.S. 23. Except Highway M-13 (U.S.23), Section 1, Town 14 North, Range 4 East. Street Address: 2844 Tupper Drive, Bay City, Michigan 48706 The redemption period shall be 6 months from the date of such sale, unless the property is determined abandoned in accordance with MCLA § 600.3241a in which case the redemption period shall be 30 days from the date of the sale.
