Notice is given under section 3212 of the Revised Judicature Act of 1961, 1961 PA 236, MCL 600.3212, that the following Mortgage will be foreclosed by a sale of the mortgaged premises, or some part of them, at a public auction sale to the highest bidder for cash or cashier’s check at main entrance #4 to the Bay County Court Facility, 1230 Washington Avenue, Bay City, Michigan that being the place of holding the Circuit Court for Bay County, Michigan starting promptly at 11:00 a.m. on March 28, 2025. The amount due on the Mortgage may be greater on the day of the sale. Placing the highest bid at the sale does not automatically entitle the purchaser to free and clear ownership of the Property. A potential purchaser is encouraged to contact the county Register of Deeds office or a title insurance company, either of which may charge a fee for this information. The Mortgage being foreclosed was given by Wenonah Park Properties Inc., a/k/a Wenonah Park Properties, Inc. a Michigan non-profit corporation whose registered office is located at One Wenonah Park Place, Bay City, Michigan 48708 to National City Bank of Michigan/Illinois, a national banking association as Trustee for the benefit of the holders of $15,455,000 Wenonah Park Properties, Inc. Revenue Bonds (Bay City Hotel Project), Series 2002. The Mortgage is dated September 1, 2002 and was recorded on September 3, 2002 in Liber 1924 in pages 389 to 409 of the Bay County Records (the “Mortgage”). UMB Bank, National Association, a national banking association, with an address of 120 South Sixth Street, Suite 1400, Minneapolis, Minnesota 55402, as the successor Trustee, is the current Mortgagee under the Mortgage. The Mortgage was assigned to UMB Bank, National Association under the Assignment of Mortgage dated July 9, 2018 and recorded on July 12, 2018 as instrument # 201809626 of the Bay County Records. No proceedings have been instituted to recover any part of the debt which is Twenty-One Million Eight Hundred Twenty-Two Thousand Four Hundred Eighty-Eight and 41/100 ($21,822,488.41) Dollars as of February 26, 2025.
