NOTICE OF FORECLOSURE BY ADVERTISEMENT. Notice is given under Section 3212 of the Revised Judicature Act of 1961, 1961 PA 236, MCL 600.3212 that the following Mortgage will be foreclosed by a sale of the premises at a public auction sale to the highest bidder for cash or cashier’s check at the place of holding the Circuit Court in Bay County, Michigan, starting at 11:00 a.m. on June 30, 2023. At the same time and place a public sale of personal property collateral will be held by the Mortgage holder, as secured party, under Section 9610 of the Uniform Commercial Code, 1962 PA 174, MCL 440.9610. The amount due on the debt is Two Hundred Eighty-One Thousand Five Hundred Thirty-One ($281,531) Dollars and may be greater on the date of sale. Placing the highest bid at the sale does not automatically entitle the purchaser to free and clear ownership of the property. A potential purchaser is encouraged to contact the county register of deeds office or a title insurance company either of which may charge a fee for this information. The Mortgage was dated December 27, 2001 and recorded January 11, 2002, with Glenn A. Williams as Mortgagor and Chemical Bank as Mortgagee which became Huntington National Bank by merger. The Mortgage was assigned on July 20, 2022 to Bay County Property Management, LLC, as Mortgagee, by Assignment recorded on July 21, 2022. The description of the Mortgaged Premises is as follows: Parcel 1: The South 40 feet of the North 197 feet of the East 153 feet of the Northeast 1/4 of the Southeast 1/4 of Section 23, Town 14 North, Range 3 East, and the North 157 feet of the East 153 feet of the Northeast 1/4 of the Southeast 1/4 of Section 23, City of Auburn, Bay County, Michigan, commonly known as 108 S. Auburn Road, Auburn, Michigan, Parcel ID No. 150-023-400-300-00; and Parcel 2: Beginning at the 1/4 post on the East line of Section 23, Town 14 North, Range 3 East, City of Auburn, Bay County, Michigan, running thence South 197 feet; thence West 153 feet; thence South 50 feet; thence East 153 feet; thence North 50 feet to the place of beginning, commonly known as 101 W. Midland Road, Auburn, Michigan, Parcel ID no. 150-023-400-280-00. The redemption period shall be 6 months from the date of the Mortgage foreclosure sale. If the above referenced property is sold at a foreclosure sale under Chapter 32 of Act 236 of 1961, under MCL 600.3278, the borrower will be held responsible to the person who buys the property at the mortgage foreclosure sale or to the mortgage holder for damaging the property during the redemption period. The Security Agreement was dated January 25, 2012 and was given by Glenn H. Williams and Mar-Glen, Inc. as debtors to Chemical Bank. It was also assigned on July 20, 2022 to Bay County Property Management, LLC as secured party. The personal property collateral is described as follows: office, bar, kitchen and dining room furniture, fixtures and equipment; kitchen and serving ware; and escrowed Michigan liquor licenses and permits from 101 W.
